1. Agreement to Terms

By booking services with Phoenix Party Bus ("we," "us," or "our"), operating at www.phoenixpartybus.net, you ("Client," "you," or "your") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Phoenix Party Bus governing use of the Site, quote requests, and any transportation reservation documented in a separate written agreement. If you do not agree to these terms, please do not use the Site or submit a reservation request.

2. Booking & Reservations

All reservations are subject to vehicle availability and must be confirmed with a signed rental agreement and deposit. Reservations are not guaranteed until the deposit has been received and a confirmation email has been sent from Phoenix Party Bus.

  • Reservations must include the date, pickup time, pickup location, estimated drop-off time, and the number of passengers.
  • Any changes to the reservation (date, time, vehicle, or itinerary) must be communicated at least 72 hours prior to the scheduled event and are subject to availability and potential price adjustments.
  • We reserve the right to substitute a comparable or upgraded vehicle if the originally reserved vehicle becomes unavailable due to mechanical or unforeseen circumstances.

3. Pricing & Payment Terms

All pricing is quoted on a per-hour basis unless otherwise specified in a custom package agreement. The following payment terms apply to all bookings:

  • Deposit: A deposit of 25–50% of the estimated total is required to secure your reservation. The exact deposit amount will be specified in your booking confirmation.
  • Balance Due: The remaining balance is due on the day of service, prior to departure. Payment must be made by credit card, debit card, or certified check.
  • Overtime Charges: If your event exceeds the reserved rental time, overtime will be billed in 30-minute increments at the prorated hourly rate. Your chauffeur will notify you as you approach the end of your scheduled time.
  • Minimum Rental:Most vehicles require a minimum rental of 3 hours on weekdays and 4–5 hours on weekends and holidays. Peak dates (New Year's Eve, Super Bowl, WM Phoenix Open, prom season) may have higher minimums.
  • Gratuity: Gratuity is NOT included in pricing. A 15-20% gratuity for your driver is customary and appreciated.

4. Cancellation Policy

We understand that plans can change. The following cancellation policy applies to all bookings:

14+ Days Before Event

Full refund of deposit. No cancellation fee.

7–13 Days Before Event

50% refund of deposit. 20% cancellation fee applied to the total quoted price.

Less Than 7 Days Before Event

No refund of deposit. 20% cancellation fee applied to the total quoted price. The full deposit is forfeited.

No-Show Policy

If the Client fails to appear at the designated pickup location within 30 minutes of the scheduled time without prior communication, the booking will be considered a no-show and the full rental amount will be charged.

All cancellations must be submitted in writing via email to info@phoenixpartybus.net. Verbal cancellations are not accepted.

5. Passenger Conduct & Safety Requirements

The safety and well-being of all passengers is our top priority. By booking with Phoenix Party Bus, you agree that all passengers will adhere to the following rules:

  • The number of passengers must not exceed the vehicle's maximum capacity as stated in the rental agreement.
  • All passengers must remain seated while the vehicle is in motion. Standing on seats, hanging out of windows, or opening emergency exits is strictly prohibited.
  • No illegal substances of any kind are permitted on the vehicle. Violation will result in immediate termination of the trip without refund.
  • Alcoholic beverages are permitted for passengers 21 years of age and older. The chauffeur reserves the right to refuse service to any passenger who is underage, overly intoxicated, or behaving in a disruptive manner.
  • Smoking, vaping, and the use of any tobacco products are prohibited inside all vehicles.
  • Passengers may not throw objects from the vehicle, use confetti, glitter, or silly string inside the vehicle, or engage in any behavior that could damage the vehicle or endanger others.
  • The chauffeur has the authority to terminate any trip if passenger behavior poses a safety risk. No refund will be issued in such cases.

6. Vehicle Damage & Cleaning Fees

The Client is responsible for any damage to the vehicle caused by passengers during the rental period. This includes but is not limited to:

  • Damage to seats, upholstery, flooring, lighting, sound systems, or any other interior or exterior components.
  • Stains, burns, or excessive soiling that require professional cleaning or repair.
  • Removal or theft of any vehicle equipment or accessories.

A minimum cleaning fee of $250 will be charged for any vehicle returned in a condition requiring excessive cleaning (including but not limited to vomit, spilled beverages, food debris, or bodily fluids). Additional repair or replacement costs will be assessed and billed separately based on the extent of the damage.

7. Liability & Indemnification

Responsibility for transportation service is governed by the reservation agreement and applicable law. However:

  • Phoenix Party Bus is not liable for delays caused by traffic, road closures, weather, mechanical breakdowns, or other circumstances beyond our control. In the event of a mechanical issue, we will make every effort to provide a replacement vehicle as quickly as possible.
  • Phoenix Party Bus is not responsible for personal belongings left in the vehicle. While we will make reasonable efforts to locate and return lost items, we are not liable for any lost, stolen, or damaged personal property.
  • The Client agrees to indemnify and hold harmless Phoenix Party Bus, its employees, agents, and contractors from any claims, damages, losses, or expenses arising from the actions or negligence of the Client or their passengers during the rental period.

8. Itinerary & Route Changes

The Client may request reasonable changes to the itinerary or route during the rental period, subject to the following conditions:

  • Changes must be communicated directly to the chauffeur and are subject to feasibility within the reserved rental time.
  • Additional stops or extended routes that cause the trip to exceed the reserved time will incur overtime charges.
  • The chauffeur may decline route changes that would violate traffic laws, compromise passenger safety, or require travel to areas deemed unsafe.

9. Force Majeure

Phoenix Party Bus shall not be held liable for failure to perform any obligation under this agreement if such failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather events, acts of terrorism, government restrictions, pandemics, road closures, or civil unrest. In such cases, we will make every effort to reschedule the booking or provide a full refund.

10. Alcohol Policy

Clients are welcome to bring their own alcoholic beverages on board our party buses and limousines. Phoenix Party Bus provides coolers, ice, and glassware as part of our standard amenities. The following alcohol-related policies apply:

  • All passengers consuming alcohol must be 21 years of age or older. The chauffeur may request identification and reserves the right to refuse alcohol service to anyone who appears to be underage.
  • Open containers of alcohol must remain inside the vehicle at all times. Passengers may not exit the vehicle with open containers in compliance with Arizona open container laws.
  • The chauffeur reserves the right to limit or cease alcohol consumption if any passenger becomes excessively intoxicated or poses a safety risk to themselves or others.
  • Phoenix Party Bus is not responsible for providing alcoholic beverages unless a special package including beverage service has been agreed upon in writing.

11. Transportation Provider & Service

The written reservation agreement should identify the legal transportation provider responsible for the assigned vehicle and driver. Do not rely on a general website description to determine the provider, vehicle, operating authority, or exact service terms for a particular trip.

  • The assigned vehicle, legal capacity, and any permitted substitution should be stated in the reservation agreement.
  • Ask the identified transportation provider to confirm the driver and operating requirements applicable to the trip.
  • Operating-authority questions should be directed to the transportation provider identified in the agreement.

12. Transportation Responsibility

Responsibility for transportation operations follows the written reservation agreement and applicable law:

  • The agreement should identify who supplies and operates the vehicle and the terms governing any substitution.
  • Complaints regarding the website or quote process may be sent to Phoenix Party Bus. Operational claims should also be directed to the transportation provider identified in the agreement.
  • Nothing in this section expands our liability beyond the limits stated in Section 7 (Liability & Indemnification), including exclusions for traffic delays, weather, mechanical issues beyond our control, lost personal property, and passenger negligence.

13. Communications Consent

By submitting a quote request through our Site, you provide prior express written consent for Phoenix Party Bus to contact you via phone calls, text messages (SMS/MMS, including automated or prerecorded messages), and email at the contact information you provided, solely for the purpose of responding to your inquiry and coordinating your booking.

  • Service communications are limited to responding to your quote request and providing reservation-related updates. This consent is required to process your inquiry but is not a condition of purchasing any service.
  • Marketing communications (promotions, deals, event ideas) will only be sent if you separately and voluntarily opted in via the optional marketing checkbox on our contact form.
  • You may opt out of marketing communications at any time by replying STOP to any text message or emailing info@phoenixpartybus.net.
  • Standard message and data rates may apply. Message frequency varies based on your inquiry.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Maricopa County, Arizona.

15. Changes to These Terms

Phoenix Party Bus reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
